When shipping your item, be sure that thefreight is pre-paid (CODs will not be accepted) and thatthe RMA number is clearly printed on the outside of thebox. Internal electronic componentsare warranted for 90 days from the date of shipmentfrom the factory, if they have been properly used. Thiswarranty will be limited to the repair or replacement ofparts and the necessary labor and services requiredto repair the goods. IT IS EXPRESSLY AGREEDTHAT THIS WARRANTY WILL BE IN LIEU OF ALLWARRANTIES OF FITNESS AND IN LIEU OF THEWARRANTY OF MERCHANTABILITY. This warrantyis the exclusive and only warranty to pass with thegoods under this contract. If notice of defect is given toDeepSea Power & Light, Inc. within such 90 day or oneyear warranty period, the sole obligation of DeepSeaPower & Light, Inc. shall be to furnish new or repairedparts free of charge in exchange for parts which havebeen proved defective and does not include any othercosts such as the cost of removal of the defective part,installation, labor, or consequential damages of anykind, the exclusive remedy being to require DeepSeaPower & Light, Inc. to furnish such new parts. Underno circumstances shall the Buyer be entitled to recoverany incidental damages as that term is defined inCommercial Code §2715.
