The Map Data for Canadamay include or reflect data of licensors, includingHer Majesty and Canada Post. Such data is licensedon an “as it is” basis. The licensors, including HerMajesty and Canada Post, make no guarantees,representations or warranties respecting suchdata, either express or implied, arising by lawor otherwise, including but not limited to,effectiveness, completeness, accuracy or fitnessfor a particular purpose. The licensors, includingHer Majesty and Canada Post, shall not be liable inrespect of any claim, demand or action, irrespectiveof the nature of the cause of the claim, demandor action alleging any loss, injury or damages,direct or indirect, which may result from the useor possession of the data or the Map Data. Thelicensors, including Her Majesty and Canada Post,shall not be liable in any way for loss of revenuesor contracts, or any other consequential loss of anykind resulting from any defect in the data or theMap Data. This Agreement is effective until such timeas (i) if applicable, your subscription term is eitherterminated (by you or by Garmin) or expires, or(ii) Garmin terminates this Agreement for anyreason, including, but not limited to, if Garminfinds that you have violated any of the terms ofthis Agreement. In addition, this Agreement shallterminate immediately upon the termination of anagreement between Garmin and any third partyfrom whom Garmin licenses the Data.Entire agreement. You agree to submit to the jurisdictionof the Netherlands for any and all disputes, claimsand actions arising from or in connection with theNAVTEQ Data provided to you hereunder.(b) For North American NAVTEQ Data and othernon-European Union NAVTEQ DataThe above terms and conditions shall be governedby the laws of Illinois, without giving effect to (i) itsconflict of laws provisions, or (ii) the United NationsConvention for Contracts for the International Saleof Goods, which is explicitly excluded. You agreeto submit to the jurisdiction of Illinois for any andall disputes, claims and actions arising from or inconnection with the NAVTEQ Data provided to youhereunder.(c) For disputes, claims and actions not related tothe NAVTEQ DataThe above terms and conditions shall be governedby the laws of Kansas, without giving effect to (i) itsconflict of laws provisions, or (ii) the United NationsConvention for Contracts for the International Saleof Goods, which is explicitly excluded.
