Section 4B: Terms & Conditions / Warranty 203Terms of Picture Mail ServiceThe Picture Mail service (“Service”) – including access to and use of the services atwww.picturemail.sprintpcs.com – is provided to you by Sprint under the followingterms and conditions and incorporate the Terms and Conditions set forth atwww.sprintpcs.com which include the Terms and Conditions of Service providedwith your PCS Phone User’s Guide, terms regarding copyright and trademarkmatters, and other terms relating to the use of our services. Your use of the Serviceindicates your acceptance of all of these terms (collectively “Terms”). Sprint maychange these Terms from time to time at our discretion with or without notice toyou. Any changes will be posted on the Service.1. EligibilityThe Service is provided to individuals who are at least 18 years old and to minorswho have parental permission. We encourage parents and guardians to take anactive role in protecting the privacy and security of their children. If you as a parenthave any concerns regarding this issue, please feel free to contact us atwww.pictures.sprintpcs.com2. Membership FeesPicture Mail is available at an additional monthly charge (in addition to any chargesyou may pay for PCS Vision services) through Sprint and provides you basicservices, such as the ability to store and share pictures taken on select PCS VisionPicture Phones or devices. Additional features or services (beyond basic services)may also be available from time to time for an additional charge. If you havepreviously not signed up for the Service with activation of yourPCS Service Plan, you may add this Service to your account for an additionalmonthly charge through a PCS Vision Picture Phone.3. Picture Mail PasswordWe will have access to your Picture Mail Password and User Name. We may remindyou of your password, at your request, by sending an email to the address you usedwhen creating your account. We will not disclose your Picture Mail Password tothird parties, but we may access your account if necessary to maintain the Service,to comply with lawful requests from governmental authorities, or in response tocourt orders, subpoenas, complaints.4. Photo LossSprint does not warrant that pictures or albums stored will not be deleted, modifiedor damaged. If pictures or images are particularly valuable, have sentimental orother intangible value or are otherwise unique or irreplaceable, reliable storagealternatives should be used, including hard copy duplication and electronic back upand storage.5. Use of Related SoftwareAny software that is provided for download and installation on your personalcomputer or electronic device in connection with the Service is licensed under theterms and conditions of a separate software license agreement. These licenseagreements are available for your review upon download, installation and/or use ofthat software.
