English 5Software License AgreementBY USING THE DNX9960/DNX7160/DNX7020EX/DNX6960/DNX6160/DNX6020EX/DNX5160,YOU AGREE TO BE BOUND BY THE TERMS ANDCONDITIONS OF THE FOLLOWING SOFTWARELICENSE AGREEMENT. PLEASE READ THISAGREEMENT CAREFULLY.Garmin grants you a limited license to use thesoftware embedded in this device (the “Software”)in binary executable form in the normal operationof the product. Title, ownership rights, andintellectual property rights in and to the Softwareremain in Garmin.You acknowledge that the Software is the propertyof Garmin and is protected under the UnitedStates of America copyright laws and internationalcopyright treaties. You further acknowledgethat the structure, organization, and code of theSoftware are valuable trade secrets of Garmin andthat the Software in source code form remains avaluable trade secret of Garmin. You agree not todecompile, disassemble, modify, reverse assemble,reverse engineer, or reduce to human readableform the Software or any part thereof or create anyderivative works based on the Software. You agreenot to export or re-export the Software to anycountry in violation of the export control laws ofthe United States of America.NAVTEQ® End-user License AgreementThe software embedded in your Garmin product(the “Software”) is owned by Garmin Ltd. or itssubsidiaries (“Garmin”). The third-party map dataembedded in or accompanying your Garminproduct (the “Data”) is owned by NAVTEQ NorthAmerica LLC and is licensed to Garmin. Both theSoftware and Data are protected under copyrightlaws and international copyright treaties. TheSoftware and Data are licensed, not sold. TheSoftware and Data are provided under thefollowing license and are subject to the followingterms and conditions which are agreed to by EndUser (“you” or “your”), on the one hand, and Garminand its licensors (including their licensors andsuppliers) and affiliated companies on the otherhand.IMPORTANT: CAREFULLY READ THIS LICENSEBEFORE USING THIS PRODUCT. INSTALLING,COPYING, OR OTHERWISE USING THIS PRODUCTINDICATES YOUR ACKNOWLEDGMENT THATYOU HAVE READ THIS LICENSE AND AGREE TOITS TERMS. IF YOU DO NOT AGREE, RETURN THECOMPLETE PRODUCT WITHIN 10 DAYS OF THEDATE YOU ACQUIRED IT (IF PURCHASED NEW)FOR A FULL REFUND TO ONE OF THE FOLLOWING:(1) THE DEALER FROM WHICH YOU PURCHASEDTHIS PRODUCT; (2) Garmin INTERNATIONAL, INC.CUSTOMER SERVICE, 1200 EAST 151st STREET,OLATHE, KS 66062, USA; (3) Garmin (EUROPE) LTD.,LIBERTY HOUSE, HOUNSDOWN BUSINESS PARK,SOUTHAMPTON, SO40 9LR, UNITED KINGDOM; OR(4) Garmin CORPORATION CUSTOMER SERVICE, No.68, JANGSHU 2nd ROAD, SIJHIH, TAIPEI COUNTY,TAIWAN.License Terms and ConditionsGarmin (“we” or “us”) provides you with storagemedia containing the computer Software (the“Software”) and the embedded or accompanyingdigital map Data, including any “online” orelectronic documentation and printed materials(together called the “Product” for purposes of thisLicense Agreement), and grants you a limited,non-exclusive license to use the Product inaccordance with the terms of this Agreement. Youagree to use this Data together with the Garminproduct for solely personal, or if applicable, foruse in your business’ internal operations, and notfor service bureau, time-sharing, resale or othersimilar purposes. Accordingly, but subject to therestrictions set forth in the following paragraphs,you may copy this Data only as necessary for youruse to (i) view it, and (ii) save it, provided that youdo not remove any copyright notices that appearand do not modify the Software or Data in anyway. You agree not to otherwise reproduce, copy,modify, decompile, disassemble, reverse engineeror create derivative works of any portion of theProduct, and may not transfer or distribute it inany form, for any purpose, except to the extentpermitted by mandatory laws.Restrictions. Except where you have beenspecifically licensed to do so by Garmin, andwithout limiting the preceding paragraph, you maynot use this Data with any products, systems, orapplications installed or otherwise connected toor in communication with vehicles, and which arecapable of dispatch, fleet management or similarapplications where the Data is used by a centralcontrol center in dispatching a fleet of vehicles. Inaddition, you are prohibited from renting or leasingthe Data or the Garmin products containing theData to any other person or third party. Only thoserental car companies that are specifically authorizedby Garmin in writing to rent Garmin productscontaining the Data to their rental customers arepermitted to rent out such products.
