To provide the best possible support, the call center agentmay need to assume remote control of the Product. This isstandard operating procedure, and the call center agent willadvise you before he or she takes control of your Product. Bycalling the call center, the Consumer expressly consents to thecall center agent taking remote control of the Product if thisis necessary to provide support.What is not covered?1. This MLW does not cover user manuals or software(including updates and upgrades to the software), settings,content, data or links, whether included or downloaded inthe Product, whether included during installment, assembly,shipping or at any other time in the delivery chain orotherwise and in any way acquired by the Consumer. Nokiadoes not warrant that any software (including updates andupgrades to the software) will meet the Consumer’srequirements or will work in combination with any hardwareor software provided by a third party, that the operation ofany software (including updates and upgrades to software)will be uninterrupted or error free or that any defects in thesoftware (including updates and upgrades to software) arecorrectable or will be corrected.2. This MLW does not cover a) normal wear and tear(including, without limitation, wear and tear of batteries,displays, or paint on the outer surface of the Product), b)defects caused by rough handling (including, withoutlimitation, defects caused by sharp items, by bending, bycompressing, or by dropping), or c) defects or damage causedby misuse of the Product, including use that is contrary to theinstructions provided by Nokia (for example, as set out in theProduct's user guide) and/or e) other acts beyond thereasonable control of Nokia.3. This MLW does not cover defects or alleged defects causedby the fact that the Product was used with, or connected to,any product, accessory, software and/or service notmanufactured or supplied by Nokia or was used other thanfor its intended use. Defects can be caused by viruses fromthe Consumer’s or from a third party's unauthorized accessto services, other accounts, computer systems or networks.This unauthorized access can take place through hacking,password mining or through a variety of other means.4. This MLW does not cover defects caused by the batteryhaving been short-circuited or the seals of the batteryenclosure or the cells being damaged or showing evidence oftampering or the battery being used in equipment other thanthat for which it has been specified.5. This MLW does not cover reduced charging capacity of thebattery, which is a result of the natural end-of-life process ofbatteries.6. This MLW does not cover any loss or corruption of, ordamage to, data or the recreation or transfer thereof even ifsuch loss was a result of a defect in the Product.7. This MLW does not cover pixel defects in the Product displaythat are within the scope of industry standards. This MLW is not enforceable if the Product has been opened,modified or repaired by anyone other than an authorizedservice center, if it is repaired using unauthorized spare parts,or if the Product's serial number, the mobile accessory datecode or the IMEI number has been removed, erased, defaced,altered or are illegible in any way as determined in the solediscretion of Nokia.9. This MLW is not enforceable if the Product has beenexposed to moisture, to dampness or to extreme thermal orenvironmental conditions, to rapid changes in suchconditions, to corrosion, to oxidation, to spillage of food orliquid, or to influence from chemical products.10. This MLW does not include any onsite service or support.11. This MLW does not cover alleged issues resulting fromevents of force majeure or other unforeseen events.12. This MLW is not enforceable if Nokia was not advised inwriting by the Consumer of the alleged defect or malfunctionof the Product no later than fourteen (14) days after theexpiration of the applicable limited warranty period.Other important noticesA third-party, independent operator provides the SIM cardand cellular and/or other network or system on which theProduct operates. Therefore, Nokia is not liable under thiswarranty for the operation, availability, coverage, services orrange of the cellular or other network or system.Make sure you make back-up copies or keep written recordsof all important content and data stored in the Product.Nokia, in a manner consistent with the provisions of thesection entitled "Limitation of Nokia's Liability" below, shallnot under any circumstances be liable, either expressly orimplicitly, for any damages or losses of any kind whatsoeverresulting from loss of, damage to, or corruption of content ordata or the recreation thereof or transfer even if such a loss,damage, or corruption was a result of a defect in the Product.Always back up your data stored on the Product before takingthe Product in for service since service activities will erase thememory of the Product, including content and data.All parts of the Product or other equipment that Nokia hasreplaced shall become the property of Nokia.
