Pursuant to FAR 12.212and 27.405-3 and Department of Defense FARSupplement (“DFARS”) 227.7202, the U.S.government acquires commercial computersoftware under the same terms by which thesoftware is customarily provided to the public.Accordingly, Keysight provides the Softwareto U.S. government customers under its stan-dard commercial license, which is embodiedin its End User License Agreement (EULA).The license set forth in the EULA representsthe exclusive authority by which the U.S.government may use, modify, distribute, ordisclose the Soft-ware. The EULA and thelicense set forth therein, does not require orpermit, among other things, that Keysight: (1)Furnish techni-cal information related tocommercial com-puter software orcommercial computer softwaredocumentation that is not customar-ilyprovided to the public; or (2) Relinquish to, orotherwise provide, the government rights inexcess of these rights customarily providedto the public to use, modify, reproduce,release, perform, display, or disclose com-mercial computer software or commercialcomputer software documentation. No addi-tional government requirements beyond thoseset forth in the EULA shall apply, except to theextent that those terms, rights, or licenses areexplicitly required from all providers of com-mercial computer software pursuant to theFAR and the DFARS and are set forth specifi-cally in writing elsewhere in the EULA. Key-sight shall be under no obligation to update,revise or otherwise modify the Software.
