We may send you notice toyour last known address in our invoicing records, or by calling leaving you a voicemessage on your wireless device or home phone. Properly addressed writtennotice is effective three days after deposit in the U.S. mail, postage prepaid. ThisAgreement is governed by and must be construed under federal law and the lawsof the State of Kansas, without regard to choice of law principles. If either of uswaives or fails to enforce any requirement under this Agreement in any oneinstance, that does not waive our right to later enforce that requirement. If anypart of this Agreement is held invalid or unenforceable, the rest of this Agreementremains in full force and effect. Section headings are for descriptive, non-interpretive purposes only. You may not assign this Agreement to any otherperson or entity without our prior written approval. This Agreement (includingany referenced documents and attachments) makes up the entire agreementbetween us and replaces all prior written or spoken agreements.Terms of Picture Mail ServiceThe Picture Mail service (“Service”) – including access to and use of the servicesat www.picturemail.sprintpcs.com – is provided to you by Sprint under the followingterms and conditions and incorporate the Terms and Conditions set forth atwww.sprintpcs.com which include the Terms and Conditions of Service providedwith your Sprint PCS Phone User’s Guide, terms regarding copyright andtrademark matters, and other terms relating to the use of our services. Your use ofthe Service indicates your acceptance of all of these terms (collectively “Terms”).Sprint may change these Terms from time to time at our discretion with orwithout notice to you. Any changes will be posted on the Service.1. EligibilityThe Service is provided to individuals who are at least 18 years old and to minorswho have parental permission. We encourage parents and guardians to take anactive role in protecting the privacy and security of their children. If you as aparent have any concerns regarding this issue, please feel free to contact us atpicturemail@sprintpcs.com.2. Membership FeesPicture Mail is available at an additional monthly charge (in addition to any chargesyou may pay for Sprint PCS Vision services) through Sprint and provides you basicservices, such as the ability to store and share pictures taken on select Sprint PCSVision Picture Phones or devices. Additional features or services (beyond basicservices) may also be available from time to time for an additional charge. If youhave previously not signed up for the Service with activation of yourSprint PCS Service Plan, you may add this Service to your account for an additionalmonthly charge through a Sprint PCS Vision Picture Phone.
