- 49 -End User License AgreementBefore opening the CD-ROM package, please read the following.You (“Licensee”) are granted a license for theSoftware defined in this End User LicenseAgreement (“Agreement”) on condition that youagree to the terms and conditions of thisAgreement.Article 1 LicenseLicensee is granted the right to use thesoftware, including the information recorded ordescribed on the CD-ROM, instruction manuals,and any other media provided to Licensee(collectively “Software”), but all applicable rightsto patents, copyrights, trademarks and tradesecrets in the Software are not transferred toLicensee.Article 2 Use by a Third PartyLicensee may not use, copy, modify, transfer,rent, lease, lend or allow any third party,whether free of charge or not, to use, copy ormodify the Software, except as expresslyprovided for in this Agreement.Article 3 Restrictions on Copying the SoftwareLicensee may make a single copy of theSoftware in whole or a part solely for back-uppurpose.Article 4 ComputerLicensee may use the Software only on onecomputer, and may not use it on more than onecomputer. Further, Licensee may not use theSoftware for commercial software hostingservices.Article 5 Reverse Engineering, Decompiling orDisassemblyLicensee may not reverse engineer, decompile,or disassemble the Software, except to theextent either of them is permitted under law orregulation of the country where Licenseeresides. Panasonic, or its distributors will not beresponsible for any defects in the Software ordamage to Licensee caused by Licensee’sreverse engineering, decompiling, ordisassembly of the Software.Article 6 IndemnificationThe Software is provided “AS-IS” withoutwarranty of any kind, either expressed orimplied, including, but not limited to, warrantiesof non-infringement, merchantability and/orfitness for a particular purpose. Further,Panasonic does not warrant that the operationof the Software will be uninterrupted or errorfree. Panasonic or any of its distributors will notbe liable for any damage suffered by Licenseearising from or in connection with Licensee’suse of the Software.Article 7 Export ControlLicensee agrees not to export or re-export toany country the Software in any form withoutthe appropriate export licenses underregulations of the country where Licenseeresides, if necessary.Article 8 Termination of LicenseThe right granted to Licensee hereunder will beautomatically terminated if Licenseecontravenes any of the terms and conditions ofthis Agreement. In this event, Licensee mustdestroy the Software and relateddocumentation together with all the copiesthereof at Licensee’s own expense.Article 9 With regard to MICROSOFT SQLSERVER COMPACT 3.5 produced by MicrosoftCorporation(1) Licensee shall use the MICROSOFT SQLSERVER COMPACT 3.5 only when included inthe Software, and shall not use theMICROSOFT SQL SERVER COMPACT 3.5 inany other configuration or method. Licenseeshall not publish the MICROSOFT SQLSERVER COMPACT 3.5 or work around anytechnical limitations in the MICROSOFT SQLSERVER COMPACT 3.5.(2) Licensee shall not use, copy, distribute,regrant for use or otherwise handle theSoftware in any way beyond the range of usegranted under Article 9 (1), and shall notconduct operations such as reverseengineering, decompilation, disassembling, etc.of the MICROSOFT SQL SERVER COMPACT3.5.(3) All rights, including copyright, patent rightsetc. relating to the MICROSOFT SQL SERVERCOMPACT 3.5 shall belong to MicrosoftCorporation. Licensee shall not claim any rightsrelated to the MICROSOFT SQL SERVERCOMPACT 3.5 whatsoever.
