Your use of software applications installed on the xSeries 150may require additional licenses -- please consult the license agreementaccompanying such software.g. Reservation of Rights. Manufacturer, and MS and its suppliers (includingMicrosoft Corporation), reserve all rights not expressly granted to you in thisEULA.2. ADDITIONAL SOFTWARE. Any Microsoft software provided to you byManufacturer, MS or Microsoft Corporation that updates or supplements theoriginal Product is governed by this EULA, unless other terms are provided withsuch updates or supplements.3. TRANSFER— Transfer to Third Parties. You may permanently transfer all of yourrights under this EULA only as part of a sale or transfer of the xSeries 150,provided you retain no copies, you transfer all of the Product (including allcomponent parts, the media and printed materials, any upgrades, this EULA and,if applicable, the Certificate(s) of Authenticity), and the recipient agrees to theterms of this EULA. No Rental. You may not rent, lease, or lend the Productexcept as expressly permitted as part of the xSeries 150 Appliance agreement.4. LIMITATION ON REVERSE ENGINEERING, DECOMPILATION, ANDDISASSEMBLY. You may not reverse engineer, decompile, or disassemble theProduct, except and only to the extent that it is expressly permitted by applicablelaw notwithstanding this limitation.5. NOT FAULT TOLERANT. THE PRODUCT MAY CONTAIN TECHNOLOGYTHAT IS NOT FAULT TOLERANT AND IS NOT DESIGNED,MANUFACTURED, OR INTENDED FOR USE IN ENVIRONMENTS ORAPPLICATIONS IN WHICH THE FAILURE OF THE PRODUCT COULD LEADTO DEATH, PERSONAL INJURY, OR SEVERE PHYSICAL ORENVIRONMENTAL DAMAGE.6. TERMINATION. Without prejudice to any other rights, Manufacturer and/orMS may cancel this EULA if you do not abide by the terms and conditions of thisEULA, in which case you must destroy all copies of the Product and all of itscomponent parts.7. CONSENT TO USE OF DATA. You agree that Manufacturer, MS and/orMicrosoft Corporation (and/or their subsidiaries, affiliates, and agents) maycollect and use technical information you provide as a part of support servicesrelated to the Product. Manufacturer, MS and/or Microsoft Corporation (and/ortheir subsidiaries, affiliates, and agents) agree not to use this information in aform that personally identifies you.8. NOT FOR RESALE SOFTWARE. Product identified as "Not for Resale" or "NFR,"may not be resold, transferred or used for any purpose other than demonstration,test or evaluation.9. BACK-UP COPY. If Manufacturer has not included a back-up copy of theProduct with the xSeries 150, you may make a single back-up copy of the Product.You may use the back-up copy solely for archival purposes.10. SINGLE COMPUTER. The Product is licensed with the xSeries 150 as a singleintegrated product. The Product may only be used with the xSeries 150, except asexpressly provided in this EULA.11. LEASED HARDWARE. In the event that you receive the xSeries 150 under theterms of a lease from Manufacturer or Manufacturer’s third-party representative,the following additional terms shall apply: (i) you may not transfer the Product toanother user as part of the transfer of the xSeries 150, whether or not transfer ofthe Product with the xSeries 150 is otherwise allowed in this EULA; (ii) yourrights with respect to any Product upgrades shall be as determined by the leaseyou signed for the xSeries 150; and (iii) you may not use the Product after yourlease terminates, unless you purchase the xSeries 150 from Manufacturer.
