If a problem develops during the limited warranty period, theConsumer should take the following step-by-step procedure:a) The Consumer shall return the Product to the place of purchase forrepair or replacement processing.b) If “a” is not convenient the Consumer shall ship the Productprepaid and insured to:Nokia Mobile Phones, Inc.Attn: Repair Department795 West Nasa Blvd.Melbourne, FL 32901The customer shall include a return address, daytime phone numberand/or fax number, complete description of the problem, proof ofpurchase, and service agreement (if applicable). Expenses related toremoving the Product from an installation are not covered under thislimited warranty.d) The Consumer will be billed for any parts or labor charges notcovered by this limited warranty. The Consumer shall be responsiblefor expenses related to reinstallation of the Product.e) If the Product is returned to NMP during the limited warrantyperiod, but the problem with the Product cannot be fixed under theterms and conditions of this limited warranty, the Consumer will benotified and given an estimate of the charges the Consumer mustpay to have the Product repaired, with all shipping charges billed tothe Consumer. If the estimate is refused, the Product will be returnedfreight collect. If the Product is returned to NMP after the expirationof the warranty period, NMP’s normal service policies shall apply andthe Consumer will be invoiced for all shipping charges.9. The Product consists of newly assembled equipment that maycontain used components which have been reprocessed to allowmachine compliance with Product performance and reliabilityspecifications.10. ANY IMPLIED WARRANTY OF MERCHANTABILITY, OR FITNESSFOR A PARTICULAR PURPOSE OR USE, SHALL BE LIMITED TO THEDURATION OF THE FOREGOING WRITTEN WARRANTY, OTHERWISE,THE FOREGOING WARRANTY IS THE PURCHASER’S SOLE ANDEXCLUSIVE REMEDY AND IN LIEU OF ALL OTHER WARRANTIES,EXPRESS OR IMPLIED. NMP SHALL NOT BE LIABLE FOR INCIDENTALOR CONSEQUENTIAL DAMAGES OR A LOSS OF ANTICIPATEDBENEFITS OR PROFITS, RESULTING FROM THE PURCHASE OR USE OFTHE PRODUCT OR ARISING FROM THE BREACH OF THE WARRANTYEVEN IF NMP KNEW OF THE LIKELIHOOD OF SUCH DAMAGES.
