37EMISSION CONTROL SYSTEM WARRANTYE m ission Control Syste m Warranty (EC S Warranty) for 1995 and later model year engines:( a ) Applicability: This warranty shall apply to 1995 and later model year engines. The EC S Warranty Period shall begin on the date the new engine or equip-m ent is purchased by/delivered to its original, end-use purchaser/owner and shall continue for 24 consecutive months thereafter.(b) G eneral E m issions Warranty Coverage: G enerac warrants to the original, end-use purchaser/owner of the new engine or equip m ent and to each subse-quent purchaser/owner that each of its engines is ...(1) D esigned, built and equipped so as to confor m with all applicable regulations adopted by the CARB pursuant to its authority, and(2) Free from defects in m aterials and work m anship which, at any ti m e during the EC S Warranty Period, m ay cause a warranted e m issions-related partto fail to be identical in all m aterial respects to the part as described in the engine m anufacturer’s application for certification.( c ) The EC S Warranty only pertains to e m issions-related parts on your engine, as follows:(1) Any warranted, e m issions-related parts that are not scheduled for replace m ent as required m aintenance in theOwner’s Manual shall be warranted forthe EC S Warranty Period. If any such part fails during the EC S Warranty Period, it shall be repaired or replaced by G enerac according to Subsection(4) below. Any such part repaired or replaced under the EC S Warranty shall be warranted for the re m ainder of the EC S Warranty Period.(2) Any warranted, e m issions-related part that is scheduled only for regular inspection as specified in theOwner’s Manual shall be warranted for the EC SWarranty Period. A state m ent in such written instructions to the effect of “repair or replace as necessary” shall not reduce the EC S Warranty Period.Any such part repaired or replaced under the EC S Warranty shall be warranted for the re m ainder of the EC S Warranty Period.(3) Any warranted, e m issions-related part that is scheduled for replace m ent as required m aintenance in theOwner’s Manual shall be warranted for theperiod of ti m e prior to the first scheduled replace m ent point for that part. If the part fails prior to the first scheduled replace m ent, the part shall berepaired or replaced by G enerac according to Subsection (4) below. Any such e m issions-related part repaired or replaced under the EC S Warrantyshall be warranted for the re m ainder of the EC S Warranty Period prior to the first scheduled replace m ent point for such e m issions-related part.(4) R epair or replace m ent of any warranted, e m issions-related part under this EC S Warranty shall be perfor m ed at no charge to the owner at a G eneracAuthorized Warranty S ervice Facility.(5) When the engine is inspected by a G enerac Authorized Warranty S ervice Facility, the owner shall not be held responsible for diagnostic costs if therepair is dee m ed warrantable.(6) G enerac shall be liable for da m ages to other original engine components or approved modifications proxi m ately caused by a failure under warrantyof any e m ission-related part covered by the EC S Warranty.(7) Throughout the EC S Warranty Period, G enerac shall m aintain a supply of warranted e m ission-related parts sufficient to m eet the expected de m andfor such e m ission-related parts.(8) Any G enerac authorized and approved e m ission-related replace m ent part m ay be used in the perfor m ance of any EC S Warranty m aintenance or repairsand will be provided without charge to the owner. Such use shall not reduce G enerac EC S Warranty obligations.(9) Unapproved, add-on, modified, counterfeit and/or “grey m arket” parts m ay not be used to modify or repair a G enerac engine. Such use voids thisEC S Warranty and shall be sufficient grounds for disallowing an EC S Warranty clai m .
